Too Late!
It’s too late because this is a movement full of leaders. You can’t lock up a key few and watch the others disperse. We are decentralized and answer to no one and nothing, save our own hearts and morals. We are all in this together. If you arrest a few hundred or a few thousand on Friday in Zuccotti Park, that will do nothing but make this movement more powerful and more resilient, as a limitless supply of leaders stands up to take the place of those removed.

Today was especially notable for the enormous, historic protests in Greece where tear gas was used against protesters. A Guardian commentary said about the situation in Greece:
Greece is split in two. On one side are politicians, bankers, tax evaders and media barons supporting the most class-driven, violent social and cultural restructuring western Europe has seen. The “other” Greece includes the overwhelming majority of the population. It was in evidence yesterday when up to 500,000 people took to the streets; the largest demonstration in living memory. The attempt to divide civil servants (ritually presented as lazy and corrupt) from private sector employees (the “tax evading” plumbers) has misfired. The only success the Papandreou government can boast is the abolition of the old right-left division – replaced by a divide between the elites and the people.

I think the global strategy here should be to demand a jury trial for all arrests. Clog up the courts first. I can’t speak for him but I have to believe Mohandas K Gandhi would have approved.
I don’t know about Gandhi, but for sure it was a tactic used by Reverend King. Jury trials aren’t guaranteed everywhere. I’m not even sure that they are guaranteed here for misdemeanor charges.
The sixth amendment of the Constitution of the United States reads:
(emphasis added)
They can’t just arbitrarily say that some classes of crimes don’t confer the right to a jury trail.

IANAL — I know what the Sixth says, but it seems to me that States aren’t bound by the same rules of procedure that the Federal Government is bound by.
I suspect that what would likely happen (if the Courts have held that the Sixth applies to State and local misdemeanors) is that the charges would be dismissed by the DA. They will have accomplished their goal of dispersing the protestors.
I dunno. But a new parody is totally up fer grabs and cleverly done, un-law-suit-able I’m sure.
Probably not with the way Congress has mucked with the copyrights to the benefit of Mickey, Minnie and crew.
That’s pretty clearly the case, Kelly. Satire and parody are still protected.
There’s a point where it’s all “legal, schmegal” because of unintended consequences.
Example – I’m going to go and talk to the Denver Occupiers tomorrow or Saturday, as there are some difficulties since the Mayor of Denver and the Gov of Co decided to screw them.
What’s going to happen is a bunch of occupation that the *Establishment can’t quell, as it will work like a waterbed; press here, rise there. You get the idea.

I don’t care what the locals say. Federal law has ascendency over state and local laws. We fought a civil war over that. I don’t see how any law enforcers in the land can say “you can’t have a jury trial”. I’m no attorney but it seems pretty unambiguous when it says, “….all criminal prosecutions….”.
Oh, sure. I’m curious about what’s going to happen when the Establishment decides to crack down hard.

The Sixth Amendment applies to the states by reason of the Fourteenth Amendment. If charged with a misdemeanor in a state court, you have the right to a jury. If charged with an infraction in a state court, you do not have the right to a jury.

Memphis is the most impoverished big city in the country, but by god, we’re good at electing folks who at least try to help us out. Now, at least (Memphis was run by an oppressive criminal cartel for decades.)

This is day 15 of #OccupySacto. On the average 2 – 4 people have been risking arrest every night. The number of police resources to make the arrests is consistently substantial. Tonight, 23 police cars + 1 paddy wagon came. Sacto is burning those taxpayer $s.
