Two of the most prominent occupations in the country are facing imminent eviction. Occupy LA and Occupy Philly have both been issued orders to leave the site they have been occupying.
Firedoglake’s Lisa Derrick, who blogs at La Figa, reports on the press conference yesterday. Occupy LA said, “Oh no! We won’t go!” And put out a statement, “All forms of weaponry used by multiple law enforcement officials – including, but not limited, to rubber bullets, pepper spray, verbal abuse, arrest, foam batons, tear gas, long-range acoustic devices and more – are not to be used on those exercising their First Amendment Rights to petition our government for redress of grievances,” ahead of the eviction.
Mayor Antonio Villairaigosa cited the success Occupy LA has had in changing the conversation and then proceeded to state, “It is time for Occupy LA to movement from this piece of parkland…It is time to close the park and restore this to a public park.” And said by 12:01 am on November 28 the eviction order would be enforced. [Derrick has been superb in her reporting from Occupy LA so follow her for updates Sunday as mass arrests are possible.]
Occupy Philly, one of the first occupations I visited when I began to tour the country to see occupations, has been told by Mayor Michael Nutter that they have 48 hours to leave because a construction project is slated to begin.
No issue has been more difficult for the City and for Occupy Philadelphia than the impending start of the $50 million project on Dilworth Plaza, where nearly 1,000 workers will remark the plaza into a green, transit-oriented place of rest.
When I met with representatives of Occupy Philadelphia on Wednesday, October 5, I informed them of the project, and when we issued a demonstration permit a few days later, we made it clear that when construction was slated to begin, the group would need to move.
Last week, the city posted an Official Notice that construction was imminent.
Today, I am happy to report that the City has approved a building permit for Center City District and its general contractor, clearing the way for the start of this 27-month construction process and the many jobs associated with it.
And so now, I am announcing that as of 5pm today everyone now encamped on Dilworth Plaza has 48-hours to remove their possessions and themselves from the project site, which will be fenced for the construction project and public’s safety starting some time next week.
Occupy Philly does not know how it is going to respond to the city yet (or has yet to release a formal statement on how they plan to handle the eviction order). There apparently is a group called “Occupy Philly Reasonable Solutions” that does not represent the group but which the city has been meeting to discuss the future of Occupy Philly. They have called for people to meet at Arch St Methodist Church at 3 pm for an emergency meeting. [Follow @DustinSlaughter for the latest.]

1:27 PM More than 7 hours later, Occupy Philly is still at City Hall. They have managed to wait out police and city officials and, in fact, Occupy Wall Street sent a Direct Action team to provide reinforcements for group that began to “sit-in” at 5 pm, which was the deadline the city set for leaving.
As for Occupy LA, the crowd has steadily grown. Thousands have gathered throughout the night to stand against the city’s plan to evict. An LAPD commander has warned there will be arrests. The raid on the camp appears to be slated to begin at midnight PST.
6:02 PM Expect the action in Philly to mostly non-confrontational. The police will control the scene carefully. They will give occupiers opportunity to leave. Those that want to engage in classic nonviolent civil disobedience, because they believe they have a right to occupy, will remain and be arrested.
A legal team is prepared to defend occupiers in court. The occupiers have been asked to not post pictures or video immediately after any incidents occur. They want to surprise police/city in court.

Michael Tracey on the scene (@mtracey reports about 15 police vehicles are at the site outside City Hall. There are a couple vehicles affiliated with Homeland Security. And, then are muncipal dump trucks there too.
Dustin Slaughter (@DustinSlaughter), also on the scene (as expected) tweets that a sit-in is underway. His tweets suggest Philly police don’t want a confrontation and will wait out the occupation until the crowd thins out. Then, they will move in and evict.

The City will probably unleash them in the middle of the night to start ripping down tents and displacing the homeless.

Yeah, I’m obsessed with DHS’s involvement. The thing is that any government agency created by Dick Cheney and his ilk is a nefarious, dangerous entity whose mission is to control rather than protect. Just because I’m paranoid doesn’t mean I’m wrong. *heh*
It is ironic that both places are being claimed for public use when that is what they are being used for now.
The oppression underway across the land is cementing public resolve to throw off these shackles and this abuse of language.
It is also nothing if not an extreme irritation to dangle the prospect of a few jobs, like a chicken in every pot, in front of people who have no prospects of genuine, dependable employment as far as the eye can see.
There are other projects which cities could worthily employ workers in doing, all the crumbling infrastructure. Doesn’t Philadelphia have any old bridges, potholes?
Final question, not to sound disrespectful but who was or is Dilworth? Not quite the most stirring name for such a momentous undertaking as the dislodging of people representing by their physical presence the proud historical beginnings of our democracy in the place of brotherly love where it all began.

Richardson Dilworth was mayor of Philadelphia for one and a half terms (1956-62) during which time he instituted a number of projects to reclaim the city. He was apparently a shakerup of the status quo, and did resign halfway through his second term. Here’s how an admirer describes his first campaign:
“He drove into the neighborhoods of the city’s enemies and stood atop a panel truck and screamed into a microphone that if they dared to debate him, if they dared to emerge from their hiding places, he would destroy them.” (“Searching for Richardson Dilworth” by Jason Fagone, www. phillymag.com)
I think he’d be willing to share his space with Occupy.

The bit about not entering alleys or rooftops in plain clothes without instruction is fascinating. The implication of this is that officers are wandering around in plainclothes but are restricted from hanging out away from the larger group. So, one easy way to figger out if the guy next to you is the poh-lice? Invite him for a rooftop chat.

The video is filled with photos of demonstrators in streets. It includes Lt. John Pike Pepper spraying UC Davis students. IMHO, this hits the tea-party demographic with which Occupy still needs help. It’s giving them, especially those under 50 permission to support Occupy. It puts more pressure on Ron Paul to show more visible support. It’s also a strong defense of the “right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” It’s also got some cross-over appeal with hip hope, really slick marketing.

Exactly. But the National Park Service folks are different feds from the DHS Federal Protective Services that protect Federal Reserve banks and courthouses.
And the photographs of any eviction would be striking.
I’ve said this before. The DHS was cobbled together out of the Coast Guard, GSA Security guards (now called the Federal Protective Service or DHS Police), FEMA, the Secret Service, and a few other miscellaneous agencies, and the airport inspection were intensified and put into a new agency, the Transportation Security Administration. Plus there are probably some things running around the Office of the Secretary DHS that might be relevant. When one points a finger at DHS, it would be very helpful to know which DHS agency (or which functionary in the Office of the Secretary) is involved.
The Congressional committee chairs and ranking members for Homeland security are Pete King (R-NY), Bennie Thompson (D-MS), Joseph Lieberman (I-CT), and Susan Collins (R-ME). And there are few “progressive” members of either committee. If you look at the list, there are any number of possible sources for pressure on DHS.
On the DOJ side, we know already that the FBI and the Community Oriented Policing Services (COPS) have been involved. It would be helpful to know what other DOJ agencies have been involved in coordinating the response to Occupy Wall Street. Where, for example, is the DOJ Office of Privacy and Civil Liberties (Director: Kirsten J. Moncada) in this?
And the FBI. How easy it is to forget the almost 100-year history of the FBI when it comes to civil liberties. Or how J. Edgar Hoover used the red scare to advance his career and how his self-promotion created part of the world view that hatched folks like Dick Cheney and the modern conservative movement.
And then there is this about the FBI:
In Congress, the chairs and ranking members are Lamar Smith (R-TX) and John Conyers (D-MI) for the House and Patrick Leahy (D-VT) and Charles Grassley (R-IA) for the Senate. The Subcomittee for the Constitution, Civil Rights, and Human Rights is chaired by Dick Durbin (D-IL) and the ranking member is Lindsay Graham (R-SC).
The politics driving the federal response is more complex than Naomi Wolf describes.

You have explained that before and I understand that there is complexity to the respond to occupy. DHS is still an entity whose motives, methods, and founding are deeply suspect. I want to know more about DHS involvement and if their role is minimal and unimportant I will be relieved. However, the questions should be asked until they are answered with documentation, IMO.
Remember that DHS was founded by the folks who told us about uranium tubes and WMD, conspired to out plame and determined energy policy with opaque impunity.

Again, I think the concern about DHS is a useful mythology to hide the role of the FBI in doing what it has always done.
I’m not wanting you to be relieved, but to look in a more detailed fashion. Broadbrush and easily dismissable allegations can be used to whitewash real concerns. There are areas of DHS operation that have been of concern from a civil liberties standpoint. Most of them deal with immigration law enforcement.
But the track record of the FBI is suppression of civil liberties is well-known. And it is clear that the DOJ has not repented of the positions that it took during the Bush administration.

The laws have become a moving target. Today’s OccupyAustin expansion to the State Capitol ran into a new curfew and a three hour limit at a time for an occupation presence. None of which ever existed before. Seems like they’re making it up as they go along.
OK if THD can take over a bit, I am still on crazy work schedule and need sleep. Can’t possibly stay up to cover possible evictions at Philly or LA, sorry.

The Wall Street Media began in the last couple of days to push the meme that (1) people of color are underrepresented in the Occupy Wall Street movement and (2) this is because of white progressives not taking black issues seriously. From what I’ve seen on the livestreams, both of these assertions are demonstrably false but it is being used to sow division in the progressive blogosphere.
From what I’ve seen local general assemblies have had to deal with this issue early on and continue to struggle with it (racism is after all the default position of American society), but they have come to the position that both race and class discrimination are interrelated. One cannot exist without the division engendered by the other. And must be both dealt with. Moreover both are instruments of 1% control of the conversation.
There is a Facebook movement pretending to be police or supportive of the police that is trying to Block Occupy Wall Street. Not going to dignify it with a link.
Also Breitbart has sockpuppet sites that get picked up in the Occupy_USA sweep and that link to (and Google bomb) negative stories on his Big Government site.

The prospect of the eviction of OccupyPhilly is troublesome to me…I lived in Philly during Frank (the Big Bambino) Rizzo’s tenure as chief of police. Rizzo once had an audience with the Pope, who mentioned protesters and his concern with the troubles in the streets, anti-war protests, crime, whatever. Rizzo’s response? “Spacco il capo, Papa, spacco il capo.” Break their heads…that became the motto of the Philadelphia PD. Rizzo is gone, but Philadelphia is still a tough town, and Philly cops are still Philly cops.
As a current resident of Philadelphia, I can say that things are very different from the Rizzo era. It should be noted that the Occupy Philly residents have divided into two factions over whether to accept the City’s proposal to relocate to an alternative public space or to remain on DIlworth Plaza.
That seems like a moot point right now. Dilworth Plaza is likely going to be cleared one way or the other. This is a common issue. Asserting a public claim to public space gets undercut by granting the city’s authority to act like a private landowner. That’s the issue.
What alternative did the City offer?

Just returned home from Occupy City of Brotherly Love. In the Quaker tradition, those seated in Dilworth Plaza vow not to be confrontational with Mayor Nutter’s Gestapo if and when they enter to dismantle the encampment. The curse for the outrage will rest solely on Mayor Nutter’s shoulders.
This is the moment that will define Mayor Nutter’s subservience to those who would crush the same people who helped elect him to office.

The Senate is going to vote on whether Congress will give this president—and every future president — the power to order the military to pick up and imprison without charge or trial civilians anywhere in the world. Even Rep. Ron Paul (R-Texas) raised his concerns about the NDAA detention provisions during last night’s Republican debate. The power is so broad that even U.S. citizens could be swept up by the military and the military could be used far from any battlefield, even within the United States itself.
The worldwide indefinite detention without charge or trial provision is in S. 1867, the National Defense Authorization Act bill, which will be on the Senate floor on Monday. The bill was drafted in secret by Sens. Carl Levin (D-Mich.) and John McCain (R-Ariz.) and passed in a closed-door committee meeting, without even a single hearing.

I’m filled with admiration for Miley Cyrus. Disney tried to package her as a plastic teeny bopper star, and as is the custom of the corporation, tried to make her more trampy and outrageous when she came of age. Other Disney female properties were denigrated and sometimes destroyed by this type of treatment. Miley Cyrus has completely broken the mold, posting a heartfelt video that will be of immense help to OWS, as you point out, by making the movement respectable amongst a country constituency stereotypically believed to belong to the Tea Party.

As my original post mentioned there is division in the Occupy Philadelphia group. Members of “Reasonable Solutions” are occupiers. They represent a compromise viewpoint. The reality is that Philadelphia is a city that does experience life-threatening winter conditions and has a long-standing program called Code Blue operated through the Office of Supportive Housing (OSH). Here is a description of the program -
“During extremely bitter cold conditions, (this is when the temperature, wind chill and precipitation combined together result in real feel temperatures near or below 20 degrees Fahrenheit), the City implements extraordinary measures to preserve the lives of chronically homeless individuals. A Code Blue emergency triggers the following:
Twenty-four hour outreach coverage, to include the teams extending hours until 12 am or later.
Access to beds that are vacant within the existing emergency housing network funded by OSH
Outreach teams and the police will be able to implement the COTS (Court Ordered Transportation to Shelter) procedure by alerting the on-call City Solicitor and Common Pleas Court Judge.
OSH funded emergency housing providers will allow clients to remain indoors throughout the day. ”
Given this reality it seems that the “Reasonable Solutions” faction’s position would allow a lasting presence in line with the spirit of the movement while recognizing a legitimate concern of the larger city community which shares their goals.
Given your rhetoric in the face of what has hitherto been Philadelphia’s supportive response in contrast to Occupy events in other cities I’m curious if you may have something in common with Patrick Howley.

“Let’s go home” (meaning back to the park) is vying with “Whose streets? Our streets.” Group is divided over tactics as police ready to clear streets.
Reminder that “this is a peaceful movement. Don’t lose sight of real problem…corporatism”.

A standoff at the moment. When there was someone in the street, the LAPD put their riot batons at the ready. There is an officer with a teargas or rubber bullet gun standing maybe four feet away from the crowd. Has not raised it, just holding it.

I have a direct contact who returned to Japan in hopes of having the opportunity to say good by to relatives who are dying of radiation poisoning (i.e. unwitting Cesium ingestion as these people are in Fukushima) unless they are already quarantined and cannot be reached. Several months ago– I estimate near the time of the tsunami in March– the US government silently evacuated 50 Japanese families here to the care of host families in Portland, OR. I had qualms about releasing this information but I believe a news piece like this means that I should share this information as I continue to see at least two central governments treat a profound human-created accident and emergency to shield responsible people and organizations, attempt to force forward the nuclear industry, not tell the respective peoples what is really going on and that continue to place profits and legacy power structures above lives, the environment, the common good and the future of the 99 percent.
So one email respondent says that “Levin’s staffer said that they’d got hundreds of calls about this.”
So, folks, you know what to do. I also would not be shy also about giving Congress a piece of your mind regarding “Preventing Real Online Threats to Economic Creativity and Theft of Intellectual Property Act” (Protect IP) and the “Stop Online Piracy Act” (SOPA).
