Charlotte, NC — Two journalists covering the Democratic National Convention were confronted on Sunday by two undercover agents who assaulted one and threatened to punch the other in the mouth for photographing them.
The two journalists, Kevin Gosztola of Firedoglake.com and Steve Horn, a Truthout contributor credentialed to cover the DNC for WORT-FM in Madison, Wisconsin, took notice of four burly middle-aged white males during a public march. The four were taking photos of the undocumented immigrant contingent in the march. They were carrying “No Papers, No Fear” blue flags and had put stickers from Code Pink on their person to make it seem like they were protesters in the demonstration. One man in an orange shirt had a black piece in one of his ears.
Horn and Gosztola followed one of the men when they left the demonstration. At the corner of North Church Street and West Fifth Street, the man in the orange shirt claimed he was a protester and did not like having his picture taken. He threatened to punch Gosztola “in the teeth.” He belligerently commanded the two journalists to cross the street. The agent in the orange shirt then grabbed Horn and pulled him to the corner where Molly MacPherson’s Scottish Pubs is located.
The orange shirt called for uniformed police officers to stop the two journalists in front of the restaurant. One of the agents chased down Gosztola, who tried to walk away. Then, on Fifth Street, a uniformed police officer ran after Gosztola, who turned when he saw the officer. He was stopped and searched.
The officer that stopped Gosztola said the men were just people who did not like having their picture taken. He asked Gosztola to turn over his phone. Gosztola deleted his photos in front of the officer in order to avoid arrest or confiscation of the device. The officer searched through Gosztola’s backpack demanded identification which he reported to authorities.
The uniformed police officer that stopped Horn told him the men were officers. The uniformed officer referred to one of the men as an “officer” when speaking with Horn.
Many of the people in the undocumented immigrant contingent came to Charlotte on a bus from Phoenix, Arizona, called the “No Papers, No Fear” bus. Four were arrested in Knoxville, Tennessee, while protesting the possible implementation of a proposed immigration law. The four were held for three days and then released.
It was the two journalists’ concern with the fact that the photos being taken by the undercover agents of undocumented immigrants exercising universal freedom of assembly and free speech rights would be for the purpose of targeting them for deportation.
“There’s nothing illegal about photographing people on the street” says Jane Hamsher, publisher of Firedoglake. “There was absolutely no provocation that could have possibly justified the thuggery and bullying by law enforcement agents of journalists who were legitimately covering a public event. It was an outrageous abridgement not only of freedom of the press, but of individual civil liberties.”

Kevin try to find the ACLUs RV and/or the volunteers they have passing out info regarding your rights with regard to the DNC and any ordinances/laws/BS that Charlotte might have imposed specifically for the DNC.
I volunteered with them at the RNC and they had fliers they were handing out regarding the specifics and case law regarding what the protesters and cops could and could not do that were specific to the RNC. I am sure they have the same materials available for the DNC.

ACLU of National Capital Area (Washington DC) would be happy to brief Kevin on the actionable, flagrant violations of his rights. They settled a case against DC police in July involving exactly the kind of “don’t take my picture I’m a cop” attitude that these douche-bags displayed. Clear-cut first amendment violation. DC’s cops (known as “MPD”) issued a general order forbidding cops from interfering with civilians taking photos or videos of cops on the street, no matter what the cops are doing.

This part I don’t understand. Why delete the photos voluntarily? Anyone- reporters even more so- are unabiguously entitled to take photos in public and do whatever they please with them. This isn’t even a gray area of the law. Then to consent to a search with no probable cause for…anything at all. Why the passivity in the face of obvious police misconduct?

oh, and just so’s we’re all clear on this, first amendment applies to federales just like it applies to regular street cops. Any kind of federales. ICE, DHS, Border Patrol, ATF, DEA, TSA, CIA, FBI, whatever ….
One more thing. Was the uniformed officer displaying a name tag? Did he have a visible badge number? Accountability will be hard to enforce without an ID of the uniformed officer.
I think it was a mistake, too. But I wasn’t there with an asshole shaking his large, hairy fist in my teeth.
I know we may be stretched thin with other legal proceedings, but I’m sure we could raise the $15,000 or $20,000 needed to sue those assholes before the DNC leaves Charlotte. I pledge $250.

We have to take turns at the Catholic church on Sundays, guarding doors, because ICE has come in and hauled folks out, during the service.

Crucial fact. Could lay the groundwork for naming the city of Charlotte and the Charlotte PD as co-defendants. Look up Monell v. Dept of Social Services and the subsequent case law on municipal liability for civil rights violations committed by municipal employees. Very powerful decision by the U.S. Supreme Court, although civil rights actions under section 1983 of the Civil Rights Act have lots of tricky procedural hoops you hafta jump through in order to sue the city properly. Also, fairly short time frames to lodge the initial “claim” with the city (following the city’s own regulations for how to assert “claims against the city”).

I am aware that I did not have to volunteer to delete the photos. It was a decision I made so I could be on my way and leave the scene. In retrospect, I should have asserted my rights fully.
And here I am asserting my rights—my right to engage in freedom of the press. I do not know where these undercovers are. They could approach me while I was still in Charlotte and confront me again. I knew this yet I did not wait to publish until after I left Charlotte. I got this out now while I am still here covering the DNC.

I heard Michael Ratner speak a couple of years ago at a very small event at Hampshire College. It was about an hour long. We chatted a bit afterwards. He struck me as low-key, very smart, with a smiling and mongoose tenacity. No flakiness detected.

Either the administration failed in “a seamless security plan that will ensure a safe environment for the community, dignitaries and event participants” or the administration is actively engaged in roughing up journalists who don’t touted the party line. They can’t claim ignorance – the best the administration could claim is failure, which I don’t think is too credible.

Law enforcement is potentially an honorable and important profession. It’s really too bad so many employed in it today in the US do it so dishonorably and unprofessionally. Too often they have become just another violent, lawless street gang- albeit one obviously far more dangerous than the ones acting without power of law. My reaction upon hearing about police killed on duty is now more or less the same as hearing a criminal street gang member has been killed in a gang war- too likely one less dangerous criminal roaming the streets terrorizing the weak and marginalized, but still a degree of sadness for their family and friends who are traumatized by the death.
This incident just fills me with feelings of Hope and Change.
Based on my experience, I don’t second-guess the decisions like the ones that Kevin had to make quickly and under threat. It always is what it is, regardless of the formal laws and rights.
If the phone had been seized though, however inconvenient that may have been at the time, it would have initiated a paperwork trail and put the name of the uniformed cop harassing Kevin into the record and forced him to concoct some putatively plausible rationale for seizing it, probably putting the names of the undercover operatives within discovery in the unlikely event the DA wanted to push the issue. Unless the policeman in question is completely stupid, he’d have realized all this too. Seizing Kevin’s phone was in all probability going to cause the cop and his superiors a magnitude of order more grief than it would cause Kevin.
How to respond when personally confronted with the state’s brutality and lawlessness is a question everyone has to answer for themselves.
But I will “blame the victim”, in this case Kevin, to this extent: aren’t there now various technological fixes applicable to the situation of the cop demanding you delete photos? For example an app that just makes it appear to the cop that you have deleted the photos? Or one that uploads photos to the net when you are deleting under duress? Or that simply uploads photos as you take them?
In your line of work, Kevin, this is a situation that will reliably recur, I think, so shouldn’t you at least have the option of outsmarting the bastards?

My experience is that sometimes there is no paperwork or it’s held “for evidence”. The surest defense is to have an automatic backup to the cloud (web) that can be activated with a hot key. Don’t know what phone apps do that for stills, but livestreaming sites do that for video as a matter of course.
Nice to see that public funds are spent employing burly cretins to photograph undocumenteds to deport for spite. The harassing of journalists while on the public dole is just the cherry on top. I hope we get to know these fellows better before the convention is over.

I’ve been trying multiple pieces of software. I know the data could still be there, but I used an iPhone to take the photos. I am unable to figure out what to do. I don’t know that it is possible to recover because my iPhone doesn’t mount on my computer. I cannot scan it like a hard drive.
Also this could be a situation that is becoming increasingly popular in that it could have been an outside official or unofficial contractor. Like the issue with the iPhone FBI hacking, it could have been private third party acting as cover in order to be out of oversight. If someone from the NCFTA stole the phone, that would put it out of FOIA and the police could basically tell you that it’s a civil matter where you’d have to sue who you thought stole your phone while the NCFTA rips everything off your phone and hands it to the Obama administration.

I’m not really that familiar with the iphone. I refuse to buy one or any apple product.
But does the SD card come out? It should for basic upgrading and the like. If so, take it out, plug it into your computer card reader (there are adapters to convert mini SD to regular SD to plug into your computer).

I know I’m a day late, but just wanted to wrap up this thread with news from ACLU of Washington, DC which is exactly on point with what happened to Kevin in Charlotte. Despite the “settlement” mentioned in mine @15, ACLU just filed another case yesterday involving the precise violation that the MPD’s (DC cops) new General Order sought to prohibit.
